Apotherium LLC ("Apotherium," "we," "us," or "our") operates "SPINERGY," a single-player iOS game further defined below. This Privacy Policy (the "Policy") explains how we collect, use, disclose, and protect your Personal Information when you use our service.
Please note that this Policy is subject to our Terms of Use Agreement (the "Terms"). There are sections in the Terms that materially affect your right to bring a lawsuit against Apotherium and other rights regarding this Policy. As such, you should read the Terms in addition to this Policy.
By using SPINERGY, you agree to the collection and use of Personal Information (as defined below) in accordance with this Policy.
1. Services this Policy Covers
Apotherium offers SPINERGY, a downloadable iOS application (the "App"), in which a single player spins virtual objects on a virtual table and is scored on how long each spin lasts and how many rotations it completes. The App is purchased once through the Apple App Store; there are no in-app purchases and no subscriptions.
We also operate this website at spinergy.app (the "Site"), which includes a support form. This Policy applies to the App and the Site (together, the "Services").
2. Services this Policy Doesn't Cover
We do not operate a web shop for SPINERGY. All purchases are processed through the Apple App Store and the way Apple processes your purchase is out of our hands. Similarly, your Apple ID, App Store account, and any payment details associated with them are governed by Apple's own privacy policy and terms. When you interact with us through the App Store or any other Apple platform, you agree to Apple's policies, and this Policy is in addition to — not in place of — those agreements. We are not responsible for errors in purchasing of third-party products.
3. What is Personal Information?
"Personal Information" is any information that may allow for an individual to be personally identified. For example, your name, email address, social security number, phone number, residential address, and credit card details are all considered Personal Information. Other information, such as your interests, economic status, customer number, IP address, geolocation, education, and job title, may also be considered Personal Information if that information, when combined with other information, is used to reveal your identity.
4. Personal Information We Collect
SPINERGY is designed to collect as little Personal Information as possible. The App does not require you to create an account, log in, provide an email address, or supply your real name, and it does not send your gameplay to us. Specifically:
4.1 In the App
SPINERGY is a single-player game that runs entirely on your device. Your scores, your settings, your chosen table surfaces, and any object profiles you draw are stored locally on your device. None of it is transmitted to us. The App does not contain an account system, a leaderboard server, analytics SDKs, or advertising SDKs.
Because the App does not talk to our servers, we do not receive:
- Your name, email address, phone number, or physical address
- Your scores, spin times, rotation counts, or play history
- The shapes you draw or any other content you create in the App
- Contacts, calendar entries, photos, microphone, or camera data
- Precise device location or GPS coordinates
- Advertising identifiers (SPINERGY does not display ads or use third-party advertising SDKs)
4.2 App Store Purchase
SPINERGY is a paid app. Apple sells it to you and processes the payment. Apple provides us with aggregate, anonymized sales and download reports through App Store Connect. We do not receive your Apple ID, name, email address, or payment card details, and we cannot link a purchase to an individual person.
4.3 On This Website
If you use the support form on this Site, you provide us with:
- Your name, email address, subject, and message. We use these only to understand and reply to your request.
Our web server also records standard access logs (IP address, timestamp, requested URL, user agent) for operational and security purposes such as rate limiting and abuse prevention. The Site does not set advertising or analytics cookies.
4.4 Spam Protection on the Support Form
The support form is protected by Google reCAPTCHA v3, which helps us distinguish real people from automated abuse. reCAPTCHA collects hardware and software information (such as device and application data, browser characteristics, and mouse and touch behavior) and sends it to Google for analysis. This use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service. The form also includes a hidden "honeypot" field that is invisible to people; submissions that fill it are discarded.
5. Authentication
SPINERGY has no accounts, no passwords, and no third-party sign-in (such as Google, Apple Sign-In, or Facebook). There is nothing for you to remember and nothing for an attacker to steal from us.
6. Cookies
The App is an iOS application, not a website, and does not set or use browser cookies. This Site does not set cookies of its own. Google reCAPTCHA, loaded only on the Support page, may set cookies in your browser under Google's control; see Google's privacy policy linked above.
7. How We Use Your Personal Information
We use the limited Personal Information we collect to:
- Respond to you: Read and reply to support requests you send us through the Site.
- Maintain and Improve: Debug issues you report, fix bugs, and improve the App.
- Protect: Detect, prevent, and address abuse, fraud, denial-of-service attacks, and other security issues, including by enforcing per-IP rate limits on the Site.
- Compliance: Comply with applicable law and respond to lawful requests from regulatory authorities.
We do not use your Personal Information for advertising, profiling, or marketing to third parties.
8. Information Sharing
We do not sell, rent, trade, or otherwise abuse your Personal Information. We only share Personal Information in the following limited circumstances:

8.2 Legal Requirements
We may disclose Personal Information if required to do so by law or in response to valid legal requests by public authorities (e.g., court orders, subpoenas). We will only share Personal Information when we believe, in good faith, that sharing your information is necessary to protect our business, our users, or that we are obligated under the law to provide such information. Given the minimal data we collect, the scope of information available for any such request is limited.
8.3 Business Transfers
If Apotherium LLC is involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your Personal Information may be transferred as part of that transaction.
9. Messages Policy
- Replies to you: If you email us or use the support form, we will reply to the email address you provide. We use it for that conversation and nothing else.
- Push notifications: SPINERGY does not send push notifications.
SPINERGY does not send marketing email, text messages, or newsletters, and we do not add support correspondents to any mailing list.
10. Data Retention
Support submissions and the email correspondence that follows them are retained only as long as needed to resolve your request and to keep a record of recurring bugs, and are deleted when no longer needed for that purpose. Web server access logs are rotated on a routine schedule. Because the App stores everything locally, your scores and drawings persist on your device for exactly as long as you keep the App installed.
11. Data Security
We implement appropriate technical and organizational measures to protect your Personal Information, including:
- Encryption of data in transit (HTTPS/TLS) for this Site and the support form
- Per-IP rate limiting and automated abuse detection
- Access controls limiting who can access backend systems and support submissions
- Regular security review of server code and infrastructure
- Collecting as little as possible in the first place — the App itself collects nothing
However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security. In the unlikely event that your Personal Information is compromised due to a security breach on our end, we will notify you, per the law, as soon as reasonably possible.
12. Your Rights and Choices
12.1 Access and Portability
Because SPINERGY does not maintain a personal profile or account for you, there is no personal "data export" to provide. The only Personal Information we may hold about you is a support request you chose to send us. You can ask us for a copy of it at legal@apotherium.com.
12.2 Deletion
You can delete everything the App holds by deleting SPINERGY from your device; this removes your local scores, settings, and any object profiles you drew. To have a support request and our correspondence about it deleted from our records, email legal@apotherium.com from the address you used.
12.3 No Subscription to Manage
SPINERGY is a one-time purchase. There is no subscription, no auto-renewal, and no recurring charge to cancel.
13. Children's Privacy
SPINERGY is suitable for general audiences but is not directed to children under 13. We do not knowingly collect Personal Information from children under 13. The App collects nothing at all; the only way to send us Personal Information is the support form on this Site. If you are a parent or guardian and believe your child has sent us Personal Information, please contact us at legal@apotherium.com and we will delete it. If you live outside of the United States, your country may apply stricter age limits.
14. Information Storage & International Users
SPINERGY is operated from the United States. This Site and any support submissions are hosted on infrastructure located in the United States. If you access the Services from outside the United States, the limited information described in this Policy will be transferred to and processed in the United States, where data protection laws may differ from those in your country.
15. Third-Party Software, Apps & Services
We always use our best efforts to pick reputable third-party software, platforms, and services. However, we do not control such third parties and are not liable for any breach of privacy or data security that occurs due to the fault of these third parties. Your interactions with the Apple App Store, Google reCAPTCHA, and any other third-party services are governed by their respective privacy policies and terms.
16. Jurisdictional Privacy Rights
Apotherium only keeps your Personal Information for as long as necessary to provide our Services and per our legal obligations. Depending on your residency, under the law (e.g., the California Consumer Privacy Act and General Data Protection Regulation), you may have the right to request at any time for us to:
- Give you access to any Personal Information that we have processed;
- Disclose third parties we have shared your Personal Information with;
- Correct any Personal Information that may have been incorrectly processed;
- Delete your Personal Information from our storage systems;
- Transfer your Personal Information to another service, when technically feasible; and
- Stop using your Personal Information in specific ways by withdrawing the consent you have given us.

We may be required to retain some Personal Information to comply with administrative, legal, or regulatory obligations. 17. Dispute Resolution
We will always try to resolve your concerns about our privacy practices promptly and hope that together we can find a solution without involving costly legal channels. However, if we cannot agree, by using our Services, you agree to binding arbitration rather than formal court proceedings to have the matter resolved. THE DISPUTE RESOLUTION TERMS IN OUR TERMS MATERIALLY AFFECT YOUR ABILITY TO BRING A LAWSUIT AGAINST US IN REGARDS TO THIS POLICY AND OUR SERVICES. PLEASE READ THOSE TERMS CAREFULLY.
18. Additional Terms
This Privacy Policy is subject to our Terms of Use. Specifically, this agreement is subject to all clauses in our Terms regarding warranties, limitation of liability, indemnification, assignment, waiver, severability, applicable law, jurisdiction, and any other Terms of Use provisions that logically ought to apply to this Policy.
19. Entire Agreement
This Policy and our Terms of Use represent the entire and exclusive agreement between our users and us. All previous written and oral agreements and communications related to the subject matter of this Policy and our Terms of Use are superseded.
20. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated Policy with a new "Last Updated" date and, where appropriate, by displaying an in-App notice. Your continued use of SPINERGY after changes become effective constitutes acceptance of the revised Policy.
